New Laws for Director Resignations

Are you planning on resigning or removing a company director?


From 18 February 2021, ASIC has changed the requirements for resigning and removing company directors. A company director will not be able to backdate their resignation more than 28 days. Also a company director is unable to resign if it means the company would be left without a director.


If a director does not notify ASIC of their resignation within the 28 day timeframe, the effective date will become the date of lodgement.


If a director requires the date of resignation to be an earlier date, the director or company would need to apply to ASIC or the court.
