TRUST DEED STAMPING

Stamp duty is a state or territory-based tax applied to certain transactions. You may be liable to pay stamp duty for the settlement (creation) of a trust or for transactions involving transferring property. Only some states and territories impose stamp duty on the settlement of a trust.

All trusts (except for except for superannuation trusts) established in either Victoria, NSW or NT must be stamped upon execution. The fees and the time-frame for the duty payable on the establishment of a trust varies per state. If your deed is not stamped within the set time-frame, interest fees will be applied by the relevant states Revenue Office.

Qorporate Services  is a registered agent of the Victorian State Revenue Office (SRO), allowing us to duty stamp Victorian Trust Deeds. The Victorian State Revenue Office (SRO) will issue the Certificate of Duty once payment has cleared which usually takes 3-5 business days.

The deeds must be correctly executed for us to be able to process the duty. The trust deeds must be dated, signed by all parties and signatures witnessed where required.

For Victorian deeds emailed to us, we will email you an official State Revenue Office digital certificate indicating the deed has been stamped, If the deed was posted to our office, we will send back your deed via express post with a print out of the Certificate of Duty.
